The use of JAMES & RITA services is subject to the Terms and Conditions of Use described below.
Therefore, Users are advised to read these Terms and Conditions carefully. For any questions or clarifications, Users may contact JAMES & RITA at info@jamesandrita.com. The User also declares to be of legal age and/or to have sufficient legal capacity to be bound by these General Conditions.
The application is free of charge. No payment is required, and no purchases may be made through it.
These Terms and Conditions of Use shall apply to the access and use of JAMES & RITA and/or any functions, content, tools, and services related to the application.
JAMES & RITA reserves the right to change or modify any of the Terms and Conditions of Use contained herein or in any service policy. Users will be informed in advance of any changes affecting the Terms and Conditions of Use and/or the functionality of the application. Any change or modification shall become effective once published on the website located at www.jamesandrita.com and/or within the JAMES & RITA application.
JAMES & RITA is a sophisticated yet easy-to-use tool that allows Users to enjoy their stay at a registered hotel from start to finish by covering all their service needs with real-time responses.
Through the application, Users may access the following functionalities:
Perform check-in using your device.
Turn your mobile phone into your room key.
Place room service orders.
Request minibar replenishment.
Laundry service requests.
Report technical incidents.
Request additional housekeeping services.
Contact concierge services for taxis or reservations.
Reserve a table at any hotel restaurant.
Chat with the hotel reception desk.
View invoices and perform express check-out.
JAMES & RITA is intended for all Users (Guests) who wish to conveniently and easily check into a hotel that is a client of JAMES & RITA, as well as request services during their stay (among those offered by each hotel) from anywhere in a simple and controlled manner.
Before downloading the application, the User must ensure that they have:
Android 5.0 or later.
iOS 8.0 or later. Compatible with iPhone, iPad, and iPod touch.
In accordance with these Terms and Conditions of Use, JAMES & RITA shall provide and/or publish new extensions or versions and other services related to the use of the application through the digital store.
In any case, it is the User’s responsibility to update the application using the functionalities provided by JAMES & RITA through the digital store.

The User agrees to use the application diligently, as well as the information related to its services and activities, in full compliance with applicable regulations, morality, generally accepted good practices, public order, the access and usage conditions, and any other conditions established in the application.
Furthermore, the User agrees to refrain from using any content for unlawful purposes or effects prohibited in this text, harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, deteriorate, or prevent the normal use of the content, other Users, or any Internet user (hardware and software).
The User is informed that during check-in, the image of their ID document and any identification data required to comply with current legislation are sent from the application, and only for a few seconds, from their mobile device so that the hotel may verify the guest’s identity.
The transmission of the image is fully encrypted, and the application requests prior authorization for such transmission.
The hotel may only view this image and may not store it under any circumstances.
In the event of a breach of these Terms and Conditions of Use, JAMES & RITA reserves the right to limit, suspend, and/or exclude access to the application, adopting any necessary technical measures. JAMES & RITA will make every effort to keep the application functioning properly, avoiding errors, correcting them when necessary, and keeping content updated. However, JAMES & RITA does not guarantee the availability and continuity of access to the application or the absence of errors in the content.

Upon downloading the application, the User will be asked to grant permission for the aforementioned accesses. The User is also informed that they may control the information or functions the application can access after installation on the device.
In accordance with Regulation (EU) 2016/679 of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, as well as Organic Law 3/2018 of December 5 on Personal Data Protection and guarantee of digital rights, JAMES & RITA, as Data Controller of the personal data provided, hereby provides the following information:

We process the data in order to provide the correct service for the use of the application to the User.
As part of the service, Users will receive notifications, push messages, or alerts. Users may manage these notifications through their device settings.
Please note that the data entered into the application will be permanently stored on the User’s device; therefore, JAMES & RITA will not store data on its servers. For the security of the User’s data, it is recommended to keep the device locked.
Data will not be shared with third parties except where legally required or with the express consent of the data subject.
Data will not be retained longer than necessary for the purposes for which it was collected, except where there is a legal obligation.
No international transfers of data to third countries outside the European Union will be carried out.
The User may exercise the aforementioned rights under the terms and conditions established in current legislation at the registered office of JAMES & RITA or by sending an email to info@jamesandrita.com.
If the User does not receive a satisfactory response and wishes to file a complaint or obtain more information regarding any of these rights, they may contact the Spanish Data Protection Agency (www.agpd.es - C/ Jorge Juan, 6, Madrid).
JAMES & RITA may require access to the device’s geolocation, which means the operating system’s location services must be used. This access is considered the collection of personal data and therefore involves transmitting geolocation data to the app.
Before installation, as well as after installation, JAMES & RITA will inform the User about the use of this system, which must be expressly accepted or rejected.
In any case, the User may revoke at any time, easily and effectively, the processing carried out by the app using the device’s location, thereby preventing JAMES & RITA from accessing location data.
The App may only access geolocation data when the User is actively using the application; therefore, this system will not remain continuously active. If continuous use of location data becomes necessary, Users will be informed beforehand and their explicit consent will be requested separately.
JAMES & RITA informs Users that the processing of personal data is always carried out in accordance with applicable data protection regulations and information society service regulations.
JAMES & RITA has implemented the necessary technical and organizational security measures to guarantee the security of the User’s personal data and prevent its alteration, loss, unauthorized processing, and/or access, in accordance with the current state of technology, the nature of the stored data, and the risks to which they are exposed, whether arising from human action or the physical or natural environment, in compliance with current regulations.
The User is solely responsible for the use made of any information or mechanisms within the application.
JAMES & RITA shall not be liable for any damage to the User’s hardware and/or software resulting from access to and use of the application. Likewise, it shall not be liable for any damages that may arise from access to and/or use of the information within the application, particularly those affecting computer systems or caused by viruses and/or cyberattacks, crashes, interruptions, absence, or defects in communications and/or the Internet.
The User shall be liable for any damages that JAMES & RITA may suffer as a consequence of the User’s failure to comply with any obligations established under these Terms and Conditions of Use.
JAMES & RITA, or its licensors, own all intellectual property rights over the Contents of the application, understood as all designs, databases, underlying computer programs (including source code), as well as the different elements that make up the application (texts, graphics, photographs, videos, colors, etc.), structure, arrangement, etc. Regarding trademarks and trade names (“distinctive signs”), they are owned by JAMES & RITA or its licensors.
The use of the application by the User does not imply the transfer of any intellectual or industrial property rights. The User is strictly prohibited from reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents or Distinctive Signs unless authorized by the holder of the corresponding rights or legally permitted.
The application may contain links to third-party websites that allow Users to access them. However, JAMES & RITA is not responsible for the content of such linked websites, and it is the User’s responsibility to accept and verify such accesses each time they use them.
Such links or mentions are provided for informational purposes only and do not imply support, approval, commercialization, or any relationship between the application and the persons or entities owning the linked sites.
These Terms and Conditions of Use shall be governed and interpreted in accordance with Spanish law.
For the resolution of any conflict arising from access to the application, the parties shall submit to the competent courts and tribunals in accordance with consumer and user regulations.
